We conducted a large-sample online mock juror survey to assist our client in defending a product liability case involving over-the-counter medication. The plaintiff had purchased a “house-brand” OTC medication manufactured by our client, and subsequently had a severe allergic reaction that spread all over her body. The focal issue in the case was the product’s omission of a warning about this specific possibility. ThemeVision developed a detailed yet concise factual summary of the case and presented this along with pictures of the plaintiff’s injuries to a large number of community members from the trial jurisdiction. Statistical analyses were used to provide feedback on how mock jurors evaluated the case, estimate the size of a damage award if one was warranted, and identify a profile of the prototypical “unfavorable” juror for use during juror selection.
